Terms and Conditions (“Terms & Conditions”) Consent

The user agrees to have carefully read the terms and conditions listed herewith. Those terms & conditions as well as the privacy policy of Tegdar Company are integral parts of the company’s subscription policy and govern your usage and browsing of the Tegdar website and app as well as all social media channels used to communicate with the user or client. Your usage of the website is considered an automatic consent on the terms & conditions of this agreement, which includes all the sections detailed below. This will be considered a commitment to the content of this agreement for the company. This Agreement will be deemed effective from the moment the website or app is used. The Tegdar Center reserves the right to change these terms and conditions at any time as needed. It is the client's responsibility to regularly review the terms and conditions without the need for the Tegdar Center to resend them.

 

Subscription and Registration

  • It is the duty of the client when disclosing any information to Tegdar company to validate the correctness and accuracy of the information provided and to ensure that it is up to date and complete according to the requirements of the registration form.
  • It is the duty of the client to report any health conditions or allergies that he might suffer from or otherwise, that may affect the diet negatively thus leading to other health problems. If such information is hidden, the client shall bear the full responsibility to the consequences of concealing those facts.
  • The company reserves the right not to accept or otherwise postpone the client’s subscription, even if the payment has been made, in the event that the client has not been notified of the approval of his subscription before the payment process was completed or in the event that the client did not pay the amounts due to the company within 24 hours of approving his subscription. It is the subscriber's responsibility to contact Tegdar company within a month from the date of payment in order to receive the service paid for.
  • All amounts paid, whether for consultation or for any other services, are non-refundable because they are time related. Correct implementation of the program is the responsibility of the client, and as a result, paid amounts are not refundable under any circumstances.
  • The subscription period starts from the date the client received the diet or exercise schedule and not from the date on which the schedule is started by the client. The subscription is valid for a full month and ends after thirty (30) days exactly from the date of schedule receipt.
  • Temporary suspension: the client can stop his subscription temporarily for only one week per month during his subscription.
  • To ensure the continuation of the subscription, the client has the right to pay more than the value of the package which will be considered as advanced payments for the coming months and would in turn help avoid the interruption of the subscription.
  • The client can subscribe for more than a month, in any type of the available packages, and get a renewal discount after the first month of subscription that continues for life. Accordingly, the package must be used within a maximum period of one month and one week from the date of subscription if the postponement is made at the rate of one week for each month of subscription (which is the maximum grace period for each month in which the subscription has been made), bearing in mind that after the expiry of the grace period, the subscription is considered null and the amount paid is due in full.

 

Personal Information

  • Tegdar company ensures all possible protection and security measures are undertaken to protect its clients’ identity and personal information such as name, address and contact numbers to avoid having unauthorized access to the information.
  • The client takes into account that any information exchanged by third parties (for example, but not limited to: WhatsApp and e-mail), follows the privacy policy, terms and conditions of that third party company and does not fall into Tegdar Company’s responsibility.
  • The client acknowledges and agrees to allow the company to use some of the information provided through this website or via any other means of communication with the company, including but not limited to weight, height, and similar information that does not affect or compromise, in any way, the confidentiality of his identity. The company acknowledges that this information will only be used in the context of public benefit for research and development purposes only.
  • Continuing with the subscription, renewing or paying for it is considered a direct acknowledgement that he has accepted all the terms and conditions as well as the privacy policy of Tegdar company.
  • To preserve the privacy of the client, each subscription and diet schedule is related to a specific phone number or membership ID. As such, none of the client’s data may be transferred to any other contact number under any circumstances.

 

Disclaimer

  • Tegdar Company will not bear responsibility towards any damage that may be caused by a cyber-attack to the client’s device or for any other technically harmful materials, which any of the client’s devices may be exposed to, due to the use of our website or as a result of downloading any materials found on any website that might be connected to it, leading to the possible disruption of the company's website, its services or affecting your devices.
  • Tegdar company bears no responsibility for the client’s non-compliance with the proposed diet or advice provided to him / her. The client must bear in mind that each person’s response to a diet varies depending on the nature of each body’s response to change. Therefore, the company bears no responsibility for the client’s inability to obtain the results he/she may expect.
  • Neither the company nor any of its employees bear any responsibility in the event that the client sends his/her diet to another person who is not subscribed under Tegdar Company’s packages as this may cause unexpected complications such as significant weight loss, increase, or other issues that would negatively affect the third party. All diet schedules are designed according to the client’s specific situation and needs and therefore, it must be clarified that the diet cannot be applied in any way to anyone other than him/her.
  • The client bears the responsibility for his health and medical condition, if any, after relative consultation from his specialist physician while taking into account that the diet program is designed by staff members specialized in nutrition in a way that suits his/her physical condition and nutritional needs. It is not Tegdar Company’s specialty to prescribe any medical or therapeutic drugs, as the company’s responsibility extends to nutritional and sports related education as well as general awareness only.
  • From the client's responsibility to retain all information and documents received from the center, including but not limited to the diet plan, exercise schedule, and any file or communication made with the center. The center is not liable for their loss or damage, and the client is not entitled to request their resend after the service period ends.

 

Follow Up and appointments

  • The client bears responsibility for sending out his measurements at the time agreed upon between him/her and the company, and is also responsible for communicating with the company on a regular basis.
  • The client has the right to inquire about any matter related to the available packages and follow up on his subscription on a weekly basis for any online package. He must also make sure to read the details of each package before choosing one and completing the subscription process. The client also takes into account that the response time of the company will be within its working hours from eight in the morning until four in the evening from Sunday to Thursday taking into account the working conditions and official public holidays in the Kingdom of Bahrain.
  • The client is responsible for responding to any messages sent by the company, including questions or motivational messages, to ensure that he/she receives a service level up to their expectations.
  • The follow-up process is necessary for Tegdar Company to ensure that the expected goal is reached. In the event that the client failed to follow-up and did not adhere to the instructions and requirements on time, the client will bear the full responsibility when/if the benefit gained from the service is minimal.
  • The duration of the consultation is a maximum of 45 minutes. Additional fees will be charged if the time allowed for the service is exceeded.
  • If the appointment is postponed or cancelled, we must be notified 24 hours before the appointment time, otherwise the session will be counted and follow-up will continue via WhatsApp.
  • It is allowed to postpone the appointment only once out of consideration for the client and after the approval of the administration.  It is not possible to postpone it for a second time, as the appointment will be counted in the event of no attendance.
  • The waiting period for the appointment is a maximum of 10 minutes, and in the event of a delay exceeding the permitted time, the session will be charged.
  • The follow-up service and the response to questions and inquiries will be paused during holidays and official vacations in the Kingdom of Bahrain. Service will resume on the next official working day. This pause is considered within the subscription period, ensuring that the client receives all the agreed-upon follow-ups as described in the package. The subscription duration is determined by the number of follow-ups, not by the number of days.

 

Subscription/Membership Cancellation

  • Mutual respect is an essential rule for subscribing in Tegdar Company’s programs. As a result, the company has the right to cancel the subscription of any client in the case he was found to have abused any employee whether verbally or physically. The company also maintains its legal rights towards this person and any payments made in this case are not refundable.
  • In the event that the client is late in communicating with the company, in order to use the services paid for, up to a period of two months from the date of payment, the subscription is considered void and the amount paid is non-refundable.
  • The company reserves the right not to accept the subscription of a client in the event that the subscription may harm his health or if the selected package does not suit his situation. In such case, the company will refund the amount paid by the customer whilst he/she bears the transfer fees and any relative taxes, only if he/she did not receive his diet schedule or any part of the service paid for.
  • The subscription is canceled immediately without refund in the case that the client has committed an act that does not fit with public morals, ethics and decorum, including but not limited to, verbal or physical abuse, cursing, slander, insults or any form of offense.

 

Force Majeure

In the event of any circumstances beyond the control of the center, such as natural phenomena, disasters, epidemics, cyber security attacks, global or internal labor strikes, power outages, or communication disruptions between the center and the client, for example but not limited to WhatsApp service or the official website of the center, which result in the inability to provide the service, the center has the right to postpone, terminate, reschedule appointments, or make appropriate decisions based on the prevailing circumstances.

 

Communication Mechanism

  • The subscription request can be made through any means of communication that is approved by the company, including but not limited to, the official mobile application, whatsapp or e-mail.
  • The company's website is a means of displaying or showcasing some of its services in addition to being an electronic payment gateway, and any service subscribed under is provided through one of the company's approved communication platforms.

 

Exchange and Refund Policy

After the payment process, cash refunds are not possible. Therefore, the paid amount for the service will be available in your membership wallet at Tegdar Center for a maximum of two months. After that, the service will be considered received and no claims for refunds or unclaimed services can be made, except in the following cases: 
1. If the center refuses to provide the service to the client due to their health condition, which may be affected by the diet in a way that does not meet their expectations.
2. If the client accidentally pays an amount greater than the intended amount. The remaining amount will be saved in the wallet and can be used within a maximum of two months. 
• Clients are allowed to exchange their package with another package of the same price or a higher-priced package, provided that the remaining amount for the other package is paid.

• The customer is not entitled to a refund for the paid amounts for the subscription if the specified period for receiving the service is exceeded due to their failure to communicate with the team. Not taking the service within the specified period cancels the service without a refund of the paid amount.

 

                                                Note: After receiving the meal plan, no refunds will be issued at all.

Intellectual Property

  • The innovative and intellectual rights of any invention, ideas or discovery made by the company are considered an integral part of its rights. The company reserves all intellectual property rights for all materials and trademarks belonging to it, including but not limited to all documents, files, ideas, marketing materials and related multimedia.

 

 

Modifications to the User Agreement

 

  • The client acknowledges that he has read and agreed to the terms and conditions and privacy policy of the company before proceeding with the subscription process. Tegdar company reserves the right to make amendments to these terms and conditions at any time in accordance to what the company deems appropriate.
  • The client agrees, in his absolute capacity, that Tegdar Company could make amendments to this agreement without requesting additional approval from the client at any time the company deems appropriate. The client is requested to periodically review this page in order to view any amendments that may have been made as those amendments are considered an integral part of these terms.

Usage Policy

Nabta Store is dedicated to providing high-quality food products to our customers. To ensure the safety, satisfaction, and proper use of our products, we have established this usage policy:

  • Store all food products in a cool, dry place away from direct sunlight.
  • Do not consume products after their expiration date.
  • Keep products out of reach of children and pets.
  • If you have known allergies, carefully read the product labels to avoid potential allergens. Review the ingredient list and allergen information available on the product packaging before consumption.
  • Follow the cooking or preparation instructions provided on the product packaging for best results.
  • By purchasing or consuming food products from Nabta Store, you acknowledge that you have read this usage policy and agree to abide by it.

 

Orders and Purchases

  • We strive to provide accurate and comprehensive information about our products, including images, descriptions, and specifications.
  • The actual product may vary slightly from the images displayed on the website.
  • To place an order, follow the purchase steps outlined on our website, which include selecting products, adding them to the shopping cart, and completing the payment process.
  • After completing the purchase, you will receive a message from our customer service via WhatsApp during business hours.

 

Prices and Payment

  • The prices listed on the website include VAT (if applicable) and any other additional fees.
  • Nabta Store reserves the right to adjust prices at any time.
  • We accept payment through [credit cards and e-wallets Apple Pay, Benefit Pay, PayPal], and we also offer installment service through Tabby with no additional fees.
  • When completing the payment process, strict security measures are employed to protect your financial information.

 

Delivery and Shipping

  • We provide delivery services to all areas covered by the store's approved delivery company.
  • Shipping methods and delivery times vary depending on the region and the requested product. You will find details about shipping options and their costs during the purchase process.
  • Once your order is shipped, it will be delivered within two business weeks. The duration may be shorter depending on the delivery area.

  • The subscriber and user acknowledge that information exchanged through third parties (such as WhatsApp and email) is subject to the privacy policy, terms, and conditions of information exchange of the respective communication service provider and not of Nabta Store.
  • The subscriber acknowledges and agrees to allow Nabta Store to use certain information provided through this website or any other communication medium with the store. This includes, but is not limited to, the number of products to be purchased, the name of the area from which the purchase was made, and similar information that does not compromise the confidentiality of the individual's identity protected by the store. The store acknowledges that this information will only be used for general benefit purposes, such as research and development.
  • Continuing with the purchase and payment process constitutes direct acknowledgment by the subscriber of acceptance of all terms, conditions, and privacy policy of Nabta Store.
  • To maintain user privacy, each purchase is linked to a specific phone number or membership, and no data may be transferred to another number under any circumstances.

 

Disclaimer

  • Nabta Store shall not be liable for any damages or losses resulting from any cyber-attacks, viruses, or other harmful technical materials that may affect your computer, mobile device, or any other equipment due to the use of our website or downloading any materials displayed on it or any linked electronic website, which may disable the services of the center's website or affect your device.
  • Nabta Store does not assume responsibility for the customer's non-compliance with the terms and conditions listed on the website in any form. Therefore, the store shall not be responsible for the customer not achieving the expected results.
  • The store or any of its employees shall not be liable if the customer gives the products to another person other than themselves, which may result in unforeseen complications due to not reading the label on the product or not inquiring about its suitability for the person using it.
  • The customer is responsible for their health condition, if any, after consulting their specialized doctor. Please note that the products available in the store are specifically selected by a nutrition science team and tested before being displayed in the store. It is not within our scope to prescribe any medical or therapeutic medications, as Nabta Store's responsibility lies in offering products related to nutrition, sports, or other areas.
  • It is the customer's responsibility to retain all information and documents received from the store, such as purchase invoices and any files or communications (in written or audio format) conducted with the store. The store is not responsible for their loss or damage, and the customer is not entitled to request their resend after the service period expires.

 

Force Majeure

In case of any circumstances beyond Nabta Store's control, such as natural phenomena, disasters, pandemics, cyber-security attacks, global or internal labor strikes, power outages, or interruptions in communication channels between the store and the customer (e.g., WhatsApp service or official website), which result in the inability to provide service, the store reserves the right to postpone product delivery, cancel orders, or take appropriate actions as deemed necessary to preserve the rights of both parties.

 

Communication Mechanism

  • Product orders can be placed through Nabta Store's website or any authorized communication channel, including but not limited to Nabta Store's website or application, WhatsApp application, or email.
  • The website serves as a platform for displaying some of the store's products and services, in addition to facilitating electronic payments. Products purchased through the store are shipped upon complete receipt of details.

 

Exchange and Return Policy

  • It is the customer's responsibility to report any damage or issues with the product within a maximum of two days from the date of receipt. No claims will be accepted after the allowed period.
  • Once payment is made, refunds in cash are not possible under any circumstances. The paid amount will remain in your membership wallet at Tegdar Center for a maximum of two months. This amount can be used to purchase other products from the store or receive services of equivalent value from Tegdar Nutrition Center.
  • Customers are not entitled to exchange or return food and health items, even if they are in their original condition, as a precautionary measure for our customers' safety.
  • Customers can only return products within two days of receipt if there is any damage. Refunds will be processed through your store membership wallet or at Tegdar Center, where the refunded amount can be used to purchase products from the store or avail services from the center within a maximum period of two months

 

Intellectual Property Rights

The intellectual and creative rights to any invention, development, ideas, or discoveries made by the store are its exclusive rights. Nabta Store retains all intellectual property rights to materials and trademarks associated with it, including all documents, files, ideas, marketing materials, and related multimedia.

 

Modifications to User Agreement

• The user acknowledges reading and agreeing to the terms, conditions, and privacy policy related to the store prior to registration. Nabta Store may make some amendments to these terms and conditions at any time to meet store requirements, and these amendments are made as deemed appropriate by the store.

• The user agrees unequivocally that Nabta Store may make major or minor amendments to this agreement without requiring additional approval from the user, at any time the store deems appropriate. Therefore, users are advised to periodically review this page to be informed of any amendments as they are an integral part of these terms.
